If you are convicted of a DUI in the Desert Ridge Justice Court you will be harshly punished. The Blood Alcohol Concentration, or BAC, in your case will dictate the exact nature of the punishment. Regardless of BAC, all DUI’s in the Desert Ridge Justice Court have some things in common:

  • They are all Class 1 Misdemeanors
  • Maximum 6 months jail sentence
  • Maximum fine of $2,500
  • Loss of driver’s license
  • Up to 5 years of probation
  • Requirement for installation of an ignition interlock device by the MVD for some period of time (period varies by BAC and prior DUI’s)

Regular DUI

A BAC between 0.08 and 0.1499 leads to a Regular DUI. A Regular DUI is also one where you are “impaired to the slightest degree” and BAC does not matter. A first time Regular DUI has mandatory minimum punishment of 10 – 180 days in jail, a $250 fine plus surcharges, approximately $1,000 in assessments, and alcohol screening and treatment classes.

That minimum punishment increases to 90 – 180 days in jail, a $500 fine plus surcharges, around $2,500 in assessments, alcohol screening and treatment classes, and at least 30 hours of community service if you have been convicted of a DUI in the 84 months prior to this conviction.

Extreme DUI

A BAC in your case of 0.15 to 0.199 results in an Extreme DUI. The mandatory minimum punishment is 30-180 days in jail, a $250 fine plus surcharges, approximately $2,000 in assessments, $250 to be paid to the DUI fund, and alcohol screening and treatment classes.

That punishment is increased if you have a prior DUI conviction in the last 84 months to 120-180 days in jail, a $500 fine plus surcharges, $2,500 or so in assessments, $250 to the DUI abatement fund, alcohol assessment and treatment classes, and at least 30 hours of community service.

Super Extreme DUI

A BAC is 0.20 or higher results in a Super Extreme DUI. The mandatory minimum punishment is 45-180 days in jail, a $500 fine plus surcharges, $250 to the DUI abatement fund, $2,000 or so in assessments and fees, and alcohol screening and treatment classes.

That punishment increases to 180 days in jail, a $1,000 fine plus surcharges, $250 to the DUI abatement fund, $2,500 or so in assessments and fees, mandatory alcohol screening and treatment classes, and 30 hours of community service if you have a prior DUI conviction in the last 84 months.

A Note of Caution

A DUI charged in the Desert Ridge Justice Court is a misdemeanor. However, if your DUI arrest is your third in 84 months; your license was suspended, cancelled, or revoked; you drove the wrong way; you had a minor under 15 in the car; or you were required to have an ignition interlock installed in your car then your DUI can be charged as an Aggravated DUI, which is a felony and is substantially more serious. Aggravated DUI’s will be charged in the Superior Court, not a Justice Court.
