A BAC of .15 to .199 qualifies as Extreme DUI, according to Arizona drunk driving laws. This is roughly twice the legal limit of .08 BAC. A second offense of Extreme DUI will mean a minimum of 120 days in jail (and 180 days in jail can be imposed), revocation of a driver’s license for one year in some cases, forfeiture of the vehicle, as well.

If the police say that your blood alcohol content was .15 or greater, you now face a legal crisis. If you are convicted of DUI with a BAC at this level, enhanced criminal and civil sanctions will apply. Drunk driving where BAC is between .15 and .199 (double the amount for “ordinary” DUI) is considered to be “Extreme DUI.”

Penalties Are Severe

Arizona DUI laws are extremely tough on convicted drunk drivers. At the extreme DUI level, the driver is considered to be an immediate risk to the public. Penalties reflect that point of view:

  • 30 to 180 days in jail
  • Reimbursement of jail costs
  • Other fines and fees
  • Probation of up to five years
  • 30-day impounding of the vehicle
  • License suspension of 90 days to one year (with a work permit possible after 30 days)
  • 12-month ignition interlock requirement after reinstatement of driver’s license
  • Alcohol Screening and Treatment

Aggressive Extreme DUI Defense Strategies

The stakes are extraordinarily high for a driver charged with Extreme DUI. Attorney Craig Rosenstein and his team pursue aggressive strategies of defense, in preparation to assertively challenge the evidence used by the prosecution. For one thing, the validity of the BAC measurement must be severely scrutinized.

Was the blood draw done correctly? Were all laboratory testing procedures done properly? Who had possession of the samples at all times? Is there proof that the sample had not been tampered with? Was there any time a lapse that could have produced a higher than actual reading of the BAC level? Did police follow all legal procedures properly such as informing you of your right to an attorney?

The best outcome for you if you were charged with Extreme DUI will most likely mean challenging the BAC in an attempt at dismissal or reduction of the charges. Your case may need to go to trial. A lawyer with ample experience handling Extreme DUI cases is essential.
