What Type of DUI Can I Be Charged with in Arrowhead County, and What Are the Potential Penalties?

Regular DUI

Regular DUIs occur when you operate a motor vehicle with a BAC of 0.08%, or 0.04% if you are driving a commercial vehicle, or any percentage if you are under the age of 21.

The possible punishments for a first-offense DUI are at least 10 days in jail, a fine of at least $1,250, plus additional fees and surcharges, alcohol screening or treatment, community service, and you must equip your car with an ignition interlock device.

For a second or subsequent offense, you will face a minimum of 90 days in jail, a minimum fine of $3,000, additional fees and surcharges, and suspension of your driver’s license for a year. In addition, you will be required to complete alcohol screening or treatment, perform community service, and equip your car with an ignition interlock device.

Extreme DUI

This type of DUI occurs if you are arrested for operating a motor vehicle with a breath alcohol content (BAC) above 0.15%.

For a first-offense Extreme DUI, you will be jailed for at least 30 days and be fined at least $2,500 plus additional fees and surcharges. Also, you will be required to complete alcohol screening or treatment, perform community service, and equip your car with an ignition interlock device.

For second and subsequent offenses, there is a minimum jail sentence of at least 120 days, a fine of not less than $3,250, and the loss of your driver’s license for a year. Furthermore, you will be required to complete alcohol screening or treatment, perform community service, and equip your car with an ignition interlock device.

Aggravated DUI 

Aggravated DUIs occur in three instances:

  1. Having a BAC of at least 0.08% while operating a vehicle while your license is canceled, suspended, or revoked;
  2. If you have 3 DUIs within 84 months; or
  3. If you are operating a vehicle with a BAC of 0.08% or more and have a passenger in the vehicle who is less than 15 years old.

You will receive a prison sentence of up to 2 years if convicted, your license will be suspended for a year, and you will be required to complete alcohol screening or treatment, perform community service, and equip your car with an ignition interlock device.

In addition, you can receive a DUI if you are under the influence of drugs, even if you are not impaired and a doctor prescribed them, including medical marijuana.

The Arrowhead (Peoria) Justice Court is located at 14264 West Tierra Buena Lane, Surprise, AZ. You can reach the Court Clerk by calling (602) 372-2000.

The Justice Court’s hours of operation are 8 AM to 5 PM Monday through Friday. The court is closed for holidays.
