The penalties for conviction of a second DUI include 90 days in jail, $3,500 or more in fines, up to five years of probation and driver’s license revocation for one year. If you are convicted of a second extreme DUI (BAC .15 to .19) the jail sentence increases to a minimum of 120 days and the minimum fine increases to $4,000. If you are convicted of a second super extreme DUI (BAC .20or higher) then the jail sentence increases to 180 days, and fines increase to a minimum of $12,000. If you are charged with a third or subsequent DUI in a seven-year period, you will face felony charges and penalties of four months minimum in state prison, more than $150,000 in fines, up to five years of probation and driver’s license revocation for three years.
