Lawyers commonly regard Driving Under the Influence (“DUI”) as one of the most severe traffic offenses. Further, it is important to note that if you are facing DUI charges in the Manistee Justice Court, it is in your best interest to immediately contact an attorney specifically in DUI defense.

Arizona law states that someone commits the crime of driving under the influence when they are engaged in the operation of a motor vehicle while impaired by drugs, controlled substances, or with a blood alcohol content (BAC) of .08% or higher. Further, Arizona law provides a more stringent burden on anyone operating a commercial motor vehicle. Specifically, if someone is found to be operating a commercial vehicle, a DUI occurs when their BAC exceeds .04%. In simple terms, if the driver of a commercial vehicle is found to have a BAC of .04% or higher, they will likely face DUI charges.

Unlike regular traffic tickets, a DUI offense carries much more severe penalties and may have an everlasting impact on your livelihood. Manistee Justice Court Criminal Process

Like many other criminal courts, the Manistee Justice Court has policies and procedures in regard to criminal cases. Specifically, the Manistee Justice Court has five (5) critical stages of a criminal case. Among these five stages are:

  1. Arraignment;
  2. Pre-trial Conference;
  3. Case Management Conference;
  4. Trial Readiness Conference;
  5. Trial

Manistee Justice Court Arraignment

In Manistee Justice Court, the arraignment serves a similar purpose to an initial appearance. At your initial appearance, you will be informed of your rights and defense options and, if imposed, your bail will be set at that time. Generally, arraignment marks the beginning of the criminal proceedings and provides a defendant with the pertinent information regarding the allegations being brought against him. You are entitled to representation at your arraignment. This is where the Court will analyze the charges that have been brought before them and determine whether you understand your rights, have retained an attorney, and how would you like to plea.

Pre-Trial Conference

Before the trial begins, a pretrial conference is conducted between the judge and both parties, the Defendant, and the State. Here, the court will clarify any plea deals being offered by the State. Further, the State and the Defense will generally exchange any evidence or preliminary discovery matters at this time.

Case Management Conference

Shortly after the Pre-Trial Conference, there is another conference that takes place, which is known as the case management conference. At the case management conference, the parties will discuss the current status of the case and exchange any outstanding evidence the parties may have. Further, the judge will inquire as to the status of the discovery and whether the parties are awaiting further evidence.

Trial Readiness Conference

The Trial Readiness Conference is the final conference until the start of the trial. Here, the Court will determine whether there has been a change in the plea or whether the parties can come to a plea agreement in a final effort to resolve the case before trial. Generally, this is the final stop for most charges because most cases are resolved in this stage, rather than proceeding to trial. It is important to note, however, that it may be in your best interest to go to trial. For that reason, it is important to have an experienced DUI defense attorney by your side.
